On August 8, 2025, the parties settled this case, entered into a settlement agreement, and jointly filed a motion to have the Court approve the settlement and enter a Consent Order which is enforceable.

Second Amended Complaint (ECF #111)

On May 23, 2018, Plaintiffs filed the original complaint in this case. After several changes were made, the Second Amended Complaint (ECF #111) was filed on July 26, 2024 and alleges that at least since 2004 the New Jersey Department of Education and Office of Administrative Law were violating numerous Procedural Safeguards under the Individuals with Disabilities Education Act (“IDEA”) and other federal statutes and sought to force the State of New Jersey to comply with those federal laws and regulations.

Opinion by the Court denying NJDOE’s motion to dismiss

After filing the original complaint in this matter, the three State defendants – NJDOE, Commissioner of Education, and OAL – and the school district involved filed a motion to dismiss the complaint. The Court granted the school district’s motion because, at the time, the due process case was not completed. But U.S. District Judge Hillman denied the State defendants’ motion and allowed the case to move forward because Plaintiffs had alleged enough facts about the systemic violations of IDEA.
